Syarat dan Ketentuan
- Promo berlaku untuk pelanggan First Media yang berlangganan paket tambahan Box Office HD / HBO Pack HD atau pelanggan combo Supreme, Maxima, Ultimate, Infinite.
- Mengisi jawaban kontes di halaman website www.firstmedia.com/hbo-gots8-screening selama periode program.
- Periode program mulai dari tanggal 12 Maret 2019 jam 00.01 wib hingga 24 Maret 2019 jam 23.59 wib.
- Satu pelanggan dapat mengisi kuis sebanyak 1 kali. Pengisian lebih dari 1 kali hanya akan diperhitungkan berdasarkan pengisian kuis yang pertama kali telah diisi dan dikirim lewat halaman kuis. Pelanggan yang dapat mengikuti kuis ini adalah warga negara Indonesia dengan usia minimal 21 tahun. Promo ini tidak berlaku untuk karyawan First Media.
- Pemenang ditentukan oleh First Media dan keputusan pemilihan pemenang mutlak hak First Media dan tidak dapat diganggu gugat.
- Pemenang yang terpilih akan dihubungi oleh First Media pada tanggal 28 Maret 2019 dan bersedia :
o Mengikuti syarat & ketentuan HBO Flyaway Contest
o Memberikan testimoni dan foto untuk diunggah di website First Media.
o Menyatakan telah memiliki paspor dengan status aktif dalam waktu 6 bulan sejak tanggal keberangkatan. - Pemenang hadiah (bersama 1 orang partner) kuis Premiere Game Of Thrones Season 08 Episode 01 Flyaway to Singapore akan mendapatkan :
o Tiket pesawat PP Jakarta – Singapore – Jakarta.
o Akomodasi di hotel bintang 5 selama 1 malam (tanggal 15 – 16 April 2019).
o Transportasi dari dan ke hotel beserta tiket masuk ke Capitol Theater untuk menikmati premiere serial Game Of Thrones Season 8 Epsiode 1 - Program ini disponsori oleh HBO ASIA untuk pelanggan First Media.
- Eligibility:
a. To participate in the Contest, you (the "Participant") must be at least 21 years old and reside in Indonesia.
b. The Organizer, its sponsors, contractors, agents, employees and immediate family members are not eligible to participate in the Contest. - As a condition to entry and participation in the Contest, each Participant agrees, represents, warrants and undertakes to the Organizer that:
a. He/she meets the eligibility requirements set out in Clause 1 above and he/she has read, understood, accepts and agrees to be bound by these Terms & Conditions, the Rules and all requirements set by the Organizer;
b. All information submitted to the Organizer is true and accurate. - The Participant acknowledges and agrees that the Organizer’s decision and records at all stages of the Contest is final, conclusive and binding and no enquiries or appeals shall be entertained. All Participants shall accept and abide by any and all decisions made by the Organizer concerning, without limitation, the Rules, the setting of question(s), selection and award of the Winner and the Prize and any other matters relating to the Contest.
- The Organizer’s sole responsibility to the Winner is to arrange for the Winner’s collection of the Prize. The Winner acknowledges and agrees that:
a. risk and title in and to the Prize vests in the Winner upon his/her collection of the Prize;
b. the Prize is not exchangeable for cash, credit or kind; and
c. utilization of the Prize is subject to the Winner’s compliance with these Terms & Conditions. The Organizer reserves the right to deal with any unclaimed Prize in any manner in which it deems fit. - The Organizer reserves the right, at its sole discretion, to immediately disqualify the Participant from further participation at any stage of the Contest and if a Winner has been selected:
a. substitute the Prize offered or any part thereof;
b. not award a Prize to a Winner and select the next best and valid entry from the entries received as an alternative Winner and transfer such Prize to such alternative Winner; or
c. forfeit, withhold or withdraw the Prize completely, if the Winner:
(i) does not meet the abovementioned eligibility requirements set out in Clause 1 above;
(ii) does not comply or is in breach of these Terms & Conditions, the Rules and/or any other requirements imposed by the Organizer;
(iii) is unable to produce any documentation required by the Organizer in relation to the Prize (e.g. proof of identity, age and address, valid and subsisting travel documents, applicable statements of eligibility and/or waiver forms);
(iv) does not sign and return a letter of acknowledgement / declaration of compliance of these Terms and Conditions and the Rules, along with a letter of acceptance of the Prize, within such time frame stipulated by the Organizer;
(v) cheats, is dishonest or commits a fraud or any other illegal activities;
(vi) misrepresents and/or provides any information that is wrong;
(vii) cannot be contacted from the details supplied; or
(viii) declines, does not claim, or is unable to claim such Prize. - The accommodation and air tickets are valid for the period of travel from 15 April 2019 till 16 April 2019 and the Winner and his/her travel companion (who must be at least 21 years old) are expected to utilise the same only during the aforementioned validity period. The validity of the Prize cannot be changed and if the Winner and/or his/her travel companion loses the chance to utilise any Prize, no other prize or compensation (monetary or otherwise) shall be awarded.
- The Winner and/or his/her travel companion shall be responsible for:
a. ensuring that they have valid travel documents/passports during their travel to Singapore and for at least six months thereafter, and shall provide such identification and/or other documentation as the Organizer may request in relation to the Prize; and
b. obtaining and maintaining the necessary visas, travel and health insurance in relation to the Prize and shall bear all costs and charges relating to the same solely at their own expense; and
c. arranging for transportation (at the Winner’s and/or his/her travel companion’s own cost) from the Winner’s and/or his/her travel companion’s respective home towns to the city of departure and arrival and back. - Any changes to the accommodation / room specifications (as provided under the Prize) requested by the Winner and/or his/her travel companion shall be at his/her/their own cost. The Winner and/or his/her travel companion shall be solely responsible for any expenses towards room services, food and beverages, personal shopping, sightseeing and local travel conveyance in Singapore. For the avoidance of doubt, the Organizer, Home Box Office (Singapore) Pte. Ltd. (“HBO Asia”), each of their parent companies, subsidiaries, affiliated, associated and related companies (collectively, “Affiliates” and each, an “Affiliate”) and each of their respective employees, directors, officers, third party agents or representatives (collectively, “Representatives”) shall not be responsible for any expenses incidental and/or related to the Winner and/or his/her travel companion or for any part of the aforementioned expenses.
- The Organizer, HBO Asia and each of their Affiliates of Representatives shall not be responsible or liable to pay any compensation of any kind for any cancellations of, changes and/or delays in any component of the Prize, the air tickets, the flight, the accommodation, the Event, and any injury, loss/ damage to property, death, incapacity or illness of the Winner and/or his/her travel companion, whether by reason of force majeure or otherwise, while utilising the Prize, while travelling to Singapore from their respective home towns, during their stay in Singapore, while carrying out activities (including any activities in relation to the Event) or for any reason whatsoever in connection with the Prize. For the purposes of this section, “force majeure” means any unforeseeable event outside of the Organizer or any of the Affiliate’s control, which may include war, threat of war, civil strife, industrial dispute, flight cancellations, terrorist activity, natural or nuclear disaster, fire, sickness, quarantine, adverse weather conditions and any other similar events.
- By participating in the Contest and/or accepting the Prize, the Participant/Winner unconditionally and irrevocably grants the Organizer, HBO Asia and each of their Affiliates and Representatives the right and consents to the use his/her personal information (including his/her name, email address and/or photo) (collectively, “Personal Data”) for purposes of:
a. administration of the Contest and the Prize (including, without limitation, displaying any Personal Data on or through the internet;
b. authentication and/or verification of any information submitted by the Participant in relation to the Contest; and
c. any promotional and/or marketing activities undertaken by the Organizer and/or any party authorized by the Organizer, in accordance with the Organizer’s Privacy Policy and Terms of Use and/or any applicable privacy and data protection laws. - In addition to the above, the Participant/Winner unconditionally and irrevocably grants the Organizer, HBO Asia, and each of their Affiliates and Representatives and/or any party authorized by the Organizer, a worldwide, perpetual, royalty-free right and license to use any material submitted as a part of their entry into the Contest, and any image, video footage, voice, likeness or other material that features or otherwise includes the Winner and/or his/her travel companion and taken at the Event (the “Works”) in any manner, for any purpose the Organizer may see fit, including for editorial, advertising, promotional and/or marketing purposes, without further compensation, in all forms of media now known or hereafter invented, in perpetuity, except where prohibited by law. To the fullest extent permitted by law, the Participant/Winner shall waive any moral rights or similar rights he/she may have in the Works or any part thereof throughout the world and undertakes not to object to any use of the Works by the Organizer and/or any party authorized by the Organizer.
- The Participant acknowledges and agrees that copyright and all intellectual property rights in and to the “HBO” and “Game of Thrones” marks and any related service and programme marks, brands, program titles, visuals, photos, names and likenesses of characters and/or performers (collectively, “HBO Property”) belong to Home Box Office, Inc. and the Participant shall not and has no right to use any HBO Property in any way whatsoever.
- The Organizer reserves the right to amend or vary:
a. any of these Terms & Conditions and/or Rules;
b. any details (e.g. date, time) of the Event; and/or
c. any component of Prize. - By participating in the Contest and/or accepting the Prize, the Participant/Winner shall indemnify and keep the Organizer, HBO Asia and each of their Affiliates and Representatives indemnified against any and all loss, damage, claims and costs suffered and/or incurred by the Organizer, HBO Asia and/or any of their Affiliates and/or Representatives as a result of the Participant’s/Winner’s and/or his/her travel companion’s:
a. participation in this Contest;
b. utilization/enjoyment of the Prize and/or any act or omission pertaining thereto; and/or
c. breach of these Terms & Conditions and the Rules. - If the Participant / Winner is required to pay any kind of taxes, including withholding tax, gift tax, duties, charges, levies in relation to the Prize as required under any applicable law, the same shall be solely and exclusively borne by the Participant / Winner.
- By participating in this Contest, the Participant hereby agrees that he/she shall not, directly or indirectly, give, promise or offer and undertake not to give, promise or offer money, donations, gifts or other benefits whatsoever in order to influence with corrupt intent the Organizer, HBO Asia and each of their Affiliates and Representatives, or any private person or business, or any employee or official of any government or government related establishment or public international authority, any political party (or candidate or official), or anyone acting on the Organizer, HBO Asia and/or any of their Affiliates’ and/or Representatives’ behalf, in the exercise of authority or in connection with obtaining any improper benefit or advantage with respect to this Contest or any matter covered by these Terms & Conditions or otherwise take any action (or fail to take action when required) that would violate any applicable laws, including but not limited to, the United States Foreign Corrupt Practices Act, the U.K. Bribery Act 2010 or any applicable local laws and/or regulations.
- By participating in the Contest, it shall be construed that the Participant has waived his/her right to:
a. raise any dispute with regard to the Prize and/or in any manner whatsoever in connection to the Prize; and/or
b. file in person and/or through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum against the Organizer, HBO Asia and each of their Affiliates and Representatives, or to claim any damages or reliefs otherwise. - Any one or more clauses, stipulations and/or provisions of these Terms & Conditions, or any part thereof, which is declared or adjudicated to be illegal, invalid, prohibited or unenforceable under any applicable law in any jurisdiction shall be ineffective to the extent of such illegality, invalidity, prohibition or unenforceability without invalidating, vitiating or rendering unenforceable the remaining clauses, stipulations or provisions of this Agreement, and any such illegality, invalidity, prohibition or unenforceability in any jurisdiction shall not invalidate, vitiate or render unenforceable any such clauses, stipulations or provisions in any other jurisdiction nor invalidate the remaining provisions of these Terms & Conditions.
- By submitting an entry to the Contest, the Participant acknowledges that he/she:
a. has read and understood these Terms & Conditions which include information on how to enter, how the Winner will be determined, the Prize, and how Personal Data will be collected, retained, used and shared;
b. expressly agrees to be bound by these Terms & Conditions, including in particular those relating to the collection, retention, use and sharing of Personal Data; and
c. confirms that he/she is not in breach of any law in his/her country of residence regarding the legality of entering the Contest.
For the avoidance of doubt, the Organizer, HBO Asia and each of their Affiliates and Representatives shall not be responsible for any Participant entering the Contest unlawfully or otherwise in breach of any local laws. - These Terms & Conditions shall be governed by and construed in accordance with the laws of Singapore.
- In the event of any conflicting interpretations between any translated version of these Terms & Conditions and the English version, the English version shall prevail.
